4 Step Process to Contract Law Essay

Question a) Step One The principle of law is that for a valid contract to be formed there must be an agreement reached by both parties. Step Two There are three main elements for the formation of a legally binding contract, intention, agreement and consideration. The requirement that requires discussion here is the existence of an agreement by the parties to enter into a legally binding contract. An agreement means a consensus on at least those essential terms needed for a workable transaction. The process of reaching an agreement is generally analysed as involving an offer and acceptance. Where the offer is a clear indication of the terms upon which a person is prepared to be bound, and an acceptance is assenting to, agreeing, or receiving the terms offered. It must be sufficiently complete, and intended to result in a contract if accepted. The requirements of an ‘acceptance’ to exist must be in the same terms of the offer. It cannot still be subject to a condition, such as where it was clear that Cameron had not intended to be bound until a formal contract was prepared and signed, Masters v Cameron (1954) 91 CLR 353. An acceptance must be made while the offer is still in existence. It must be made by a person whom the offer was addressed. If the offer is intended to be made to any person that learns of it then any such person can accept the offer on the stated terms. For the process of offer and acceptance to result in agreement, the terms of the offer must be accepted without suggesting changes. This notice was not part of the agreement as it was not in the initial contract and therefore the hotel was made liable. Step Three The review of whether an agreement has been reached between both parties involves determining the requirements of an offer and acceptance have been met. Firstly, for an offer to exist, it must be intended to result in a contract is accepted. The advertisement made by Games Travel Ltd is not viewed as an offer by the courts because advertisements are not intended to signal a readiness to be bound, but rather an invitation asking customers to make an offer to buy. Secondly, for the requirements of an acceptance to exist, it must be in the same terms of the offer. Question b) Step One The area of law relevant to this question is the review of a contents of a contract enforced between two parties. Policy considerations may limit freedom of contract. There are certain statements that do not become part of the contract but are said in negotiations. This includes puffs, opinions and representations. Puffs are statements of exaggerated praise to excite buyers and encourage sales and are without any real or measurable substance. Opinions are statements of personal views or beliefs and should not be relied on as it may be incorrect. If a person misrepresents their true opinion, their statement is treated as a representation. Representations are statements often made to encourage the other party to enter the agreement, without intending that they be contractual promises. For example Oscar Chess Ltd v Williams [1957] 1 All ER 325, the car dealer sued Williams for breach of contract due to the car age document being false. The courts decided the document was a mere representation rather than a contractually binding promise. The terms of a contract describe the entire contents of a legally enforceable agreement. Terms are ‘express’ when they have actually been declared or definitely stated. There are disagreements over whether particular terms have been included in the contract or not. For example Causer v Browne [1952] VLR 1 the statement on the docket was not seen as contractual terms as it was only an identifying docket. A term may also be ‘implied’ into a contract when that term was intended to be part of the contract without being expressly stated or referred to. It can only be implied if it is obvious that the parties had intended to include the term as part of their agreement. Implied terms must be reasonable and fair, be capable of clear, unambiguous expression and it must not contradict any express terms. In Codelfa Construction v State Rail Authority of NSW (1982) 149 CLR 337 Codelfa tried to claim extra payment for the extra costs incurred due to stopping and starting work overnight. The courts rejected this as there was no such term implied that would see unforeseeable stoppage to work and compensation paid out. A breach of contract that causes loss gives rise to a claim for damages. If sufficiently serious, a breach may justify a claim to damages plus a refusal to accept performance. To evaluate the seriousness of a breach various terms are distinguished and some terms are described as ‘conditions’ and the others ‘warranties’. Conditions are terms of fundamental importance to the agreement, whereas warranties are terms of lesser importance than conditions. In a breach of condition an injured party can terminate contract and/or sue for the damages. Whilst in a breach of warranty the injured party can sue for damages. In Associated Newspapers Ltd v Banks (1951) 83 CLR 322 Bancks, the cartoonist had the right to terminate his contract as the promise to publish Blancks drawing’s on the front page of the comic section was a condition term. Step Three Identifying the content of the contract between Jon and Games Travel Pty Ltd shows that there are express terms that exist within the contract. For example, the two tickets for the price of one, and the tickets to the finals in the swimming, archery and gymnastics. These terms are contractual terms and must be carried out as specified by the agreement. The terms sought throughout the contract are categorised as warranties, as they are not terms of fundamental importance. Such terms are the swimming tickets, where Jon had received men’s event and not the women’s. Also, the ticket price was doubled when charged, the initial contract was $1000 which is a warranty term. Terms that are conditional are the actual flight to the Commonwealth Games in India. Breaches of Warranty terms such as the swimming ticket and $2000 charge would be a breach of contract. In such a case, the remedy available for breaching warranties are to claim for damages only. This would include $1000 which Jon was overcharged. Step Four In conclusion, through analysis of the contents of the contract a breach of warranty has arisen. The remedy of such can include a sue for damages incurred.

In the case of security, the F value is high, i.e, 3.49 and the significance level is low,i.e., 0.72. This suggests that the null hypothesis is discredited and the means could be significantly different; hence those who are informed the survey is for testing their motivation may have reported different values from those not so informed. But the true results on the job constructs may be held to be those stated by those unaware of the motivation test. Maslow’s test reveals that levels of motivation may not be very high among the participants in this survey because the general trend in the responses is towards the lower scale.

Roles And Responsibilities Of Trade Union Management Essay Trade Union is defined in the Employment Relations Act 2008 (Appendix 1) as an association of persons, whether registered or not, having as one of its objects the regulation of employment relations between workers and employers The Trade Union or Labour Union movement is a continuous and voluntary association whose membership comprises of salary earners, employees and union leaders. Those members have bonded together motivated by a simple motto Unity makes strength. Workers will therefore utilise trade unions as their representative voice when dealing with employers or on the board of directions. Independently, the workers do not bear the power to defy the top management. Therefore they grouped and seek to institute their terms and conditions of employments. When they realised that negotiating as an individual, the manager would be more powerful, due to the fact that an individual would not matter as much a group in regard of running an organisation. According to Cunnison, Trade Union is a monopolistic combination of wage earners who stand to the employers in a relation of dependence for the sale of their labour and even for the production, and that the general purpose of the association in view of that dependence is to strengthen their power to bargain with the employers The main role of trade union is to ensure the welfare of its members such as safeguarding the interests of its members, protecting the reliability of its trade, achieving higher wages by securing economic benefits. It also optimises the working conditions at the workplace and guarantees a job security while protecting members against unfair dismissal at workplace. Through its leadership, trade union engages in collective bargaining, whereby labour contracts are negotiated with the employers. Also it acts as a recruiting manager, the Union leaders interfere with the recruitment and selection of the company, its intention is to maximise the number of employees an employer can hire. 2.2 Hierarchy of Trade Unions There is a hierarchy in Unions, we had identified; the confederation, the federations and the trade unions. Regarding the confederation, there are one main which is Mauritius Labour Congress and it is affiliated to the International Confederation of Free Trade Unions (ICFTU).In the category of federation there are; National Trade Union Confederation (NTUC) which is affiliated with the International Trade Union Confederation (ITUC) and the Mauritius Trade Union Congress (MTUC). Finally, the trade unions which are affiliated to the NTUC; The Federation of Civil Service Unions, Federation of Progressive Unions, Federation des Travailleurs Unis, Confederation Mauriciennes des Travailleurs, General Workers Federation and Federation of Free Workers. 2.3 Structure of Trade Union The trade unions structure is divided into several parts, namely: The Annual Delegates Congress It is the authority which governs the federation. The Executive Council It comprises of one representative of each affiliates which is usually the secretary or the president and the Bureau members and two observers per affiliates. Once every two months they conduct meeting regarding applications for affiliates from trade unions and affiliation of the Federation to any local, regional or international organisation promoting the interest of the workers and to discuss disagreements between different affiliates. Meeting can be scheduled on the demand of the President or the Bureau or of the members of the Executive Council too. The Bureau It comprises of the President, the General Secretary and the eight elected members. Among them, one is the 1st Vice president and another is the 2nd vice president, a 3rd as Assistant Treasurer and a fourth one who is the organising secretary. President He represents the Federation and he is the spokesman of the federation. General secretary The General Secretary arranges meetings and draw up the minutes of the meeting. Along with the General Secretary, Deputy General Secretary and the Assistant General make up the Secretariat of Federation. Treasurer He is in charge of the accounts of the federation. Organising Secretary He is in charge of organising events like training sessions, seminars, workshop among others. Public Relation Officer He deals with the media for conferences, coverage, reports and other information that will be published by the media. 2.4 Nature and Scope of Trade Union The existence of an influential and recognised trade union is a pre-requisite to the industrial development pace of the country. With modernization in different sectors and the formation of new one such as the technological one as well as the tourism sector, human resources were required. However, mistreatment of the Mauritian labour force appears. This is where the trade union emerged; they ensured that the human rights of their members are respect as per the laws and the constitution. Trade Unions are currently considered as a sub-system which attends a precise sub-groups interest. When defending a particular sector they consider themselves as an integral part of the organisation in respect to the feasibility, growth and development of the community of which they formed part of. The influence of Trade Unions is of key importance for their members in the following ways: First, they are more effective and efficient when the need of negotiation is required between employers and employees by attempting to create a win-win situation. They facilitate the flow of communication between workers and the management, by providing the guidance and support to both of them. The Union leaders will seek a health and safety in the working environment. In addition, they also act as an educational institution; they provide different types of courses to their members. They also accelerate the pace of economic development for instance; they act as a recruiting and selecting agent for the unemployed workers, managing conflicts in the organisation, inculcating corporate social responsibilities to the members among others. 2.5 Objectives of trade unions. The main body of a trade union usually consists of individual workers, sometimes professionals and past workers. Their primary aim is to ensure that the employment conditions of employees are respected and that fair working conditions are offered. However, trade unions also engage in issues like: Negotiation Representation Information and advice Member services Negotiation One of the main targets of trade unions is to negotiate with employers about the matters affecting their members and other employees at work. If a union is formally recognised by an employer, it can negotiate with the employer over terms and conditions. These negotiations are commonly known as collective bargaining. Any trade union works to protect and advance the interests of its members. One of the ways it achieves this is by collectively bargaining with employers about the pay and conditions under which its members work. The negotiation process normally deals with matters such as working rules and regulations, complaint procedures, hiring principle, dismissing or promoting employees, workplace safety and policies etc. Some trade unions even have the power to negotiate rates of pay, bonuses for target achievement, employment conditions and job descriptions on behalf of the employees. For collective bargaining to be effective, unions and employers need to agree on how the arrangement is to operate. The objective of that collective bargaining or negotiation process is to settle with a mutual agreement also known as collective agreement between the management and the trade union. Representing Body Employees and other workers have the right to be accompanied at a disciplinary or grievance hearing. They can either choose a co-worker or a union representative. Often, the union representative, will be a workplace representative who is also a co-worker and will support the employee on the board meeting. Information and Advice If someone forms part of a union he/she can also ask them for advice. Unions are experts at solving problems at work. Trade unions provide staff with information, advice and guidance about any work related problems. Member Service Trade unions provide its members with a variety of services such as training, insurance, financial assistance and legal advices, sickness benefits, education facilities in some cases, guarantee of satisfactory work conditions in areas such as health and safety as well as equal opportunities. Voice in decision affecting Workers Trade unions act as a spokesperson for the staff. When matters concerning an individual employee or a group of workers arise, the trade unions job is to voice out the problem in order to negotiate for a solution. In case no agreement is settled or respected, the trade union members may enforce strikes or resistance to lockouts. They can also intervene in order to resist schemes of the management which reduce employment, e.g. restructuring and automation 2.6 Types of Trade Union Craft or Occupation Union. This type of union was the earliest type developed, it comprised of employees of a particular craft or skill regardless of place of work. The advantage of craft unionism is the sense of solidarity, as there is a feeling of common interest between the members. In addition, as this union bears skilled workers, they have a good economic position for collective bargaining. On the other side, more and more new mechanical devices were being developed, the need for large numbers of skilled workers decreased. One- Shop Union or House Union The one-shop union organizes all workers in the same establishment or factory. This type of union has the advantage of being relatively easy to organize because all workers share a common goal in securing a good collective agreement for their particular factory. However, as it is small, it has little bargaining power and it is easily dominated by management. Common Employer Union. 2.7 Characteristic of Trade Union Trade unions have shown remarkable progress since their inception in Mauritius and as the union is an essential and dynamic aspect of the society it bears special characteristics such as: Trade Union come together for common goals and interest The members have some materials of collective interest such as improving working conditions, better wages, benefits, job security among others. In so doing, the employer and employee relationship is enriched and enhance the quality and welfare of the employees. 2.8 Functions of Trade Unions Broadly speaking, trade unions perform two types of functions: Militant Function Amongst the various activities performed by trade unions is the betterment of the position of their members in relation to their employment. The aim of such activities is to ensure that all the clauses of the hiring and psychological contract are respected. When the union fails to accomplish these aims through collective bargaining and negotiation, in extreme conditions they adopt drastic measures in the form of go-slow, strike, boycott, work sabotage etc. to make the management react and reconsider their requests. Hence, these functions of the trade unions are known as militant or fighting functions. Fraternal Function Another actions performed by trade unions are to provide help to its members in needy times, and improving their efficiency. Trade unions try to nurture a spirit of cooperation, mutual aid and promote friendly relationships and sharing of knowledge and culture among their colleagues. In some cases, they also arrange for legal assistance. Besides, these, they undertake many welfare measures for their members, e.g., school for the education of children, library, reading-rooms, in-door and out-door games, and other recreational facilities. These activities, which may be called fraternal functions, obviously depend on the availability of funds, which the unions raise by subscription from members and donations from outsiders, and also on their competent and enlightened leadership. The Role of the Catholic Church In The New World The Catholic Church during the Middle Ages played an all encompassing role over the lives of the people and the government. As the Dark Ages came to a close the ideas of the Renaissance started to take hold, and the church's power gradually began to wain. The monarchies of Europe also began to grow, replacing the church's power. Monarchies, at the close of the Middle Ages and the dawn of the Renaissance, did not so much seek the guidance of the church as much as it sought their approval. However, the Church during the Age of Discovery was still a major influence. The discovery of the New World and its previously unknown inhabitants presented new problems in the Catholic Church in the late 14th and early 15th century. When Spain's rulers and emissaries decided to physically conquer and populate the New World, and not just trade with it, the transplantation of Christian institutions followed. The church established contact with the New World, and made it a goal to establish the Catholic doctrines among the native population there. The Catholic Church and the Spanish monarch, however, looked upon the native population in the New World as souls to be saved. They did not consider or treat the Indians as equals. The implanting of Christianity in the New World, and the treatment of the native population by the missionaries and christian conquerors was detrimental to New World. Through men such as Cortez and Las Casas accounts of the conversions have been recorded. One of the reasons for this was the alliance of the Catholic Church with the Spanish monarchy. The status of the Indians was disregarded as the Christian conquers and missionaries who wanted to convert them subjected the... ...d to work toward goals that they did not fully understand. Racism and White People Essay

According to Roscoe & Hight, parodies are engaging works, that present themselves as documentaries but are not, and contain non-factual text. They work on several levels creating humor, sparking anger and sometimes critical reflection in the viewers. Both parodies and satires rely on the sophistication of its audience and a general familiarity with its content. Their comic elements can only be appreciated if one recognizes the objects are being mocked. The mock-documentary can only develop inherent complexity as seen in parodies, if its viewers are familiar with the documentaries codes and conventions and it serious intent. The use of parody is well established in the film â€Å"Babakieueria†. The film begins with a group of Aboriginal people arriving by boat on the Australian foreshores and attempting to communicate with a group of white people. When the new arrivals manage to communicate an enquiry as to the name of this place, the white people respond with ‘Babakiueria’ (BBQ area). The humor highlights the patronising approach taken by white people to Aboriginal Australians over the centuries and captures many of the issues surrounding racial inequality and racism. Through humor, it invites viewers to participate in its reversal of events and to find humor in the insight into white Australian culture one gains by seeing it through the eyes of an audience. For example, the interviewer queries an Aboriginal man getting out of his car, â€Å"Excuse me sir. What do you think about white people? † The man answers: â€Å"White people? You’ve got to be joking. † The film thus employs a desire to know more about the other in a slightly different way (humor). It puts viewers momentarily into the position of the contemporary descendants of colonized people—minority, disempowered, misunderstood—and uses humor to perhaps make viewers more receptive to this increased self-knowledge. By the use of humor, It really encourages you to think about racial inequalities and the stereotypes, assumptions and opinions that are still prevalent in society and the media today. Moreover, it tests the viewer’s abilities to distinguish between truth and fiction by presenting them in a satire style that makes it difficult to decipher between the two. The audience is given the opportunity to decide whether they will accept what they are shown or ignore it as a joke. From the way I see it, the jokes are primarily aimed at particular public figures, sending the overall message that racial views are still rampant in our society today, and that there is not much we can do about it except feel superior. This type of humor is not ultimately about how useless it is to care about racial issues; rather it is premised on the feeling that there are racial issues out there that we should care deeply about.

Internation Recruitment and Selection Essay

The world has been rapidly transforming due to the changes in technology, innovations, and the reduction of trade barriers into and out of countries which have permitted globalization. Due to globalization human resource management has been forced to take a more international approach, and has demonstrated that a more effective management of human resources internationally is imperative for the success of companies in international business (Shen). Therefore international organizations need to understand the roll that plays the international human resource management (IHRM) department, and the importance of adopting an effective recruiting, selecting, and training strategies that will enable the company to select the right talent for the right places. IHRM plays a very important and challenging roll in the international setting of organizations because â€Å"they must develop practices which will maintain congruence with the overall strategic plan of their respective multinational c orporations, while balancing the economic, social, political, and legal constraints of the host countries† (Caligiuri). Companies understand that the only way to develop strong and successful global leaders, which are keys to competitive advantage, is through an IHRM department that has a well develop competitive strategy in place. Multinational Corporations (MNCs) like Unilever and Huawei Technologies Co., a Chinese networking and telecommunications supplier, have understood the importance of a well develop IHRM department and have implemented strategies that are aligned with a global approach that support the business operation worldwide (Gartsdie). Based on Heenan and Perlmutter model there are four competitive strategies as well as different training alternatives for global assignees that MNCs can use to develop a successful IHRM approach. The recruitment and selection (staffing) policies which MNCs implement for their foreign subsidiaries will vary greatly for every company, and should be determine accordingly with the IHRM approach the organization is pursuing (Ball). MNCs can be divided in four types based on their management approach and corporate philosophy. The first approach a MNC may consider is the ethnocentric approach which is â€Å"characterized by low pressures for cost reduction and low pressures for local responsiveness† (Ball). Ethnocentric MNCs are not willing to give up the control over foreign subsidiaries, and prefer to place expatriates employees belonging to the home country of the firm, in all key management positions abroad. IHRMs departments that adopt this approach believe that expatriates are more capable than employees of the host country, and they expect that their expatriate managers transfer headquarters’ culture and philosophy to the host nationals (Caligiuri). This approach is normally used by MNCs with primarily international strategic orientations in the early stages of globalization. The advantage of an ethnocentric approach is that it expands the experience of expatriates and prepares them for high level management positions who execute strategic decisions from headquarters. Many expatriates adapt, learn the language, and perform effectively within the host country (Ball). However data suggest that there is a high turnover rate among expatriates because many of them do not have the special set of skills, characteristics, and abilities (e.g. tolerance of ambiguity, adjust quickly, empathy, actively manage social contacts) that are required to be successful in such position (Caligiuri). Because of the previous statement it is imperative that MNCs understand that facilitating proper training and development to the expatriate is a very important part of the IHRM department because it has a major impact on the effectiveness of the expatriate manager and â€Å"research has shown that cross-cultural training is an effective intervention to prevent expatriate failures† (Deller). However MNCs today face a big problem because studies show that only fifty percent of all expatriates receive adequate training (Deller). Another very important aspect to the IHRM department needs to consider when selecting the right candidate under this approach is to keep in mind the impact in the family of the expatriate. The family’s willingness and ability to adjust is of crucial importance for the assignee’s employer and it needs to be address during the staffing process as well. Another disadvantage for this approach is that is more costly for the corporation because it has to offer more incentives to the expatriate (Deller). In the selection process it is the responsibility of the IHRM department to evaluate the efficiency and cross-cultural proficiency of the candidates to ensure the success of this approach. The polycentric staffing policy is a second approach that can be implemented by IHRM departments of MNCs. Under this approach the human resource department will look for host country nationals (HNC) to manage subsidiaries in their own country with some coordination form headquarters (Ball). With this approach IHRM departments do not need to worry about looking for certain skills or characteristics for an international setting because the candidates are employed at the subsidiary level and they do not have language and culture barriers, labor turnover reduces, productivity increase, there are ideal information of industry, legal and political configuration, and the first cost of employing them is less expensive. Also using this approach makes the subsidiary looks less foreign (Caligiuri). However the problem with hiring HCNs is that they are not familiar with the home country of the international company and with its corporate culture, policies, and practices (Ball). The underlying crisis in communication and control between the headquarters and the subsidiary due to language barriers, conflicting national loyalties and differences in personal values may create an inconsistency in the strategic management process that will result in the subsidiary operating as a separate unit. Home country national’s lack of exposure to international assignments and lack of career mobility among HCNs are also some disadvantages of this approach and ultimately will affect the competitive advantage of the MNC (Padala). According to the article of Jie Shein, â€Å"HCNs are included in management development schemes only at the subsidiary level and HCN managers are rarely promoted to senior management positions† (663). When staffing under this approach IHRM departments can choose from hiring HCNs in the home country or HCNs in the host country. Many MNCs have experienced difficulties in hiring high caliber of HCNs managers because of the lack of long-term IHRM planning and training and ineffective international management development (Shen). When the polycentric staffing approach is not adequate the regiocentric staffing approach might be a better option. The regiocentric staffing approach can be used for companies with a regional strategic approach. In this approach employees are selected for key positions within the region the subsidiary is operating, employing a variety of HCNs and third country nationals, TCNs (Ball). From this perspective the communication and integration systems must be highly sophisticated for headquarters to maintain control over the regions however the host national are given the opportunity to manage their own subsidiaries. The likelihood of HNCs career advancement is greater within the region, but still limited in headquarters (Caligiuri). The training and development for this approach are the same as with the polycentric staffing approach. One of the biggest advantages of this approach is that it serves as a bridge for MNCs to gradually move to a geocentric staffing approach. The geocentric staffing approach is used in companies with a transnational strategic orientation. This staffing approach seeks the best people for key jobs throughout the organization, regardless of nationality, selecting the best person for the job, irrespective of nationality is most consistent with the underlying philosophy of a global corporation (Padala). This approach is ideal because the human resource strategy will be the same across all subsidiaries, using the best practices from wherever they might be found across the MNC worldwide networking of operations (Ball). However one of the drawbacks of this approach is that it can be expensive to implement because of increased training, compensations packages, and relocations costs, and it could require longer lead time (Padala). IHRM staffing approaches are very important but training and development also play a very important role in the international setting. International training and development is one of IHRM’s most crucial activities. While it is true that MNCs recognize the significance of international training and development for their employees there is knowledge that this corporation’s training strategies are weak and not effective. Current researches show that today the majority of companies have ineffective training and management policies that have resulted in frequently employee failure (Shen). In order to succeed in the global arena MNCs need to implement an effective international training and development program for expatriates, HCNs, and TCNs. Globalization has definitely created a very competitive business market in which international human resource management plays a crucial role for the success on multinational corporations. It is imperative that corporation carefully analyze every staffing approach available and implement the one that will help them select the right candidates for the right position, and provide the candidates with the appropriate training and development in order to create a competitive advantage. “Lord of the flies” by William Golding Analysis

Choose a novel in which the novelist makes effective use of symbolism. Show how the writer made use of this technique to enhance your appreciation of the text as a whole. In your answer you must refer closely to the text, and to at least three of symbolism, theme, structure, or any other appropriate feature. â€Å"Lord of the Flies† by William Golding Have you ever imagined being stranded on a fictitious tropical island? , Or how about waking up one morning with a group of children on an island and finding out there is no sign of adult life? In the book â€Å"Lord of the flies† by William Golding these circumstances come true as a group of young boys are stranded on an island as they face their fight for survival following a plane crash. The boys face a tough task on the island as they face the expectance of the unknown. The first sign of symbolism in the book is when one of the little boys, also known as ‘the littluns', tells the group that he saw â€Å"A snake-thing. Ever so big†. This puts the group into an uproar about how some sort of beast is lurking on the island. Also you can read Analysis July at the Multiplex Being holder of the conch, Ralph tries to calm everybody down by saying â€Å"he must have had a nightmare†, but Jack just has to pop in stating that â€Å"if there was a snake we'd hunt it and kill it. During the night of the boy's search for the beast, Jack claims to have seen it. The following morning he calls a meeting and lets everyone know that there is really a beast. The beast a creation of the boys' minds, reflected as the most frightening object ever. The â€Å"beast† was slowly transformed from a bear to a flying, invisible, living thing, which eats everything in its way, especially human beings. It holds fear in the most terrifying way causing the end of the book to develop like it does. Although the beast they imagine doesn't exist, they flinch at the thought of the beast. This changes their behavior; they are so scared that they do not wander alone in the jungle. This fear, which the beast causes in the boys, allows Jack to keep his tribe under his command by creating an image for him. He is looked up upon as someone gutsy and strong, not scared of the beast unlike everyone else. The fire on the mountain is a symbol of escape and hope, and used as a signal for attracting the attention of passing boats/planes which might rescue them. Ralph introduced this idea in an attempt to establish a shift of kids for the maintenance of the fire. Towards the middle of the book, the shift wasn't followed, resulting in the fire being put out. It is easy to understand that when the fire burns high the boys have a high sense of hope of being rescued, but when the fire burns low because of neglect there is a low sense of hope and depression affects them all. Despite all of Ralph's attempts to keep the fire going throughout the book, Jack's authority is too strong and with the tribe Jack formed, Ralph is forced to let it burn out since he has no one to take care of the fire. The lord of the flies is a pig's head on a stake used as a sacrifice for the beast. It is given this name for the swarm of flies, which surround it. Jack believes that by giving the beast some food, the beast will not bother his tribe. At one point in the novel, it appears to be talking to Simon defining what is evil and what is good. This conversation inspires Simon to go to the mountain to find the beast. He realizes that the beast does not exist and this leads him to his death when he is brutally killed by the other kids because they thought he was the beast. The scar symbolizes a wound caused by mankind upon an untouched natural island. It is the place where the airplane crashed on the island. It plowed through the thick jungle, creating an area of chopped-down trees and shrubs. This is the place where Piggy and Ralph first met. Piggy introduced himself and became Ralph's companion. The conch is an symbol of peace, organization, and honesty for it has an authority which Ralph created at the beginning of the book. The conch is used to establish order in the boy's meetings because whoever has the conch, has the right to speak. The conch gave order in a world without grown ups and, like the law, it was respected, but when the kids realize that there was no punishment for disobeying it, they took advantage of the freedom to rebel against it. In the end of the book, when the conch is destroyed, Ralph is forced to give up and, with him; all the desperate attempts to be civilized are pointless. Golding presented numerous themes and basic ideas that give the reader something to think about. One of the most basic and obvious themes is that society holds everyone together, and without these conditions, our ideals, values, and the basics of right and wrong are lost. Golding is also showing that morals come directly from our surroundings, and if there is no civilization around us, we will lose these values. There were many other possible secondary themes I noticed in the book such as people will abuse power when it's not earned, When given a chance, people often single out another to degrade or improve their own security, You can only cover up inner savagery so long before it breaks out, given the right situation, It's better to examine the consequences of a decision before you make it than to discover them afterwards and the fear of the unknown can be a powerful force, which can turn you to either insight or madness. One thing I found interesting about this novel was I recognized that we must study and compare the characters of Jack and Ralph to understand Golding's meaning of the novel. Once the author lets the reader find the characters of similarities and differences it lets them understand Jack's and Ralph's rivalry. Golding tries to tell us a lesson of staying in a civilized society and not entering the dark and gloomy society. Watch the people around you for the people closest may be the people about to destroy civilization and the chance of being saved in this case. The Lord of the Flies† has so far been the one of the most interesting books I have ever read. The book is extremely addictive and written very cleverly, it did not take long for me to get into and finish it. Golding is an author with deep thoughts and a good understanding of human nature, which was very noticeable throughout the novel. I felt the novel was certainly both entertaining and educational. Entertaining in a way that the book is packed full of death, torture and most importantly, realism. Reading this book made feel as though I had my own character role in my mysterious exploration of the unknown. The educational side of the book I think was being on the adventure. What you learned from your experience. It lets you see what kind of issues you would have to handle or face up to if you were on the island with the others. If I was to trapped on an island now I think actually reading Lord of the Flies who fill me with experience and ideas to take me through my fight for survival.
